The Jones Act workers compensation plan does not cover everyone. For instance, Jones act workers compensation does not cover longshoremen and dock workers. These are two jobs where people are putting themselves in danger, and the government has recognized the risk the workers are putting themselves through and created the Longshore and Harbor Workers Compensation Act to cover maritime claims who work as longshoremen, harbor workers, or dock workers.

The Defense Base Act is an extension of the Longshore and Harbor Workers Compensation that protects workers who are United States citizens that are employed either under contract with the American government for national defense or public works or that are working on a United States military base.

The Defense Base Act specifically covers injuries that result in death. If a worker that is covered under the act is to die, he or she would receive reasonable funeral expenses up to the amount of 3,000 dollars. Benefits are also received by survivors. The Defense Base Act is known for being friendly towards its claimant because of the way it goes about handling DBA attorneys fees.

While the Jones Act workers compensation plan covers sailors and their claims, it does not cover longshoremen, harbor workers, and dock workers. The benefits from the LHWCA (Longshore and harbor workers compensation Act) are paid by authorized employers that are self insured. However, sometimes the benefits can be paid through a carrier of authorized insurance.

In order to make sure that sailors and other workers on and near the ocean are safe, the Jones act workers compensation plan and LHWCA make sure that claims will be heard from injured workers and sailors and that they are covered to be compensated.

  1. I would not want to work without being covered. It just seems like a bad idea. You are risking too much. If you get hurt or cannot work and do not have coverage so that you can make a claim, then you are sunk.
